En tant que<br \/>Participant \u00e0 des activit\u00e9s, des programmes, des classes, des services fournis et des \u00e9v\u00e9nements parrain\u00e9s ou organis\u00e9s<br \/>par Avenir Elite Football Acad\u00e9mie, y compris, mais sans s'y limiter, les matchs, les tournois et les entra\u00eenements,<br \/>formation, formation personnelle, formation \u00e0 sec, utilisation de la musculation et du conditionnement physique<br \/>\u00e9quipements, machines et installations, programmes nutritionnels et di\u00e9t\u00e9tiques, programmes d'orientation ou de formation, etc.<br \/>instructional sessions or lessons, aerobic and anaerobic conditioning programs (collectively the<br \/>\u201cActivities\u201d), the undersigned being the Participant and Participant\u2019s Parent\/Guardian<br \/>(collectively the \u201cParties\u201d) acknowledges and agrees to the following terms outlined in this<br \/>agreement:<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>I am the Parent\/Guardian of the Participant and have full legal responsibility for the decisions<br \/>of the Participant.<br \/>Description of Risks<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>The Parties understand and acknowledge that:<br \/>a) The Activities have foreseeable and unforeseeable inherent risks, hazards and<br \/>dangers that no amount of care, caution or expertise can eliminate, including without<br \/>limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life;<br \/>b) The Organization may offer or promote online programming (such as webinars,<br \/>remote conferences, workshops, and online training) which have different foreseeable and<br \/>unforeseeable risks than in-person programming;<br \/>c) The Organization has a difficult task to ensure safety and it is not infallible. The<br \/>Organization may be unaware of the Participant\u2019s fitness or abilities, may give incomplete<br \/>warnings or instructions, may misjudge weather or environmental conditions, and the<br \/>equipment being used might malfunction; and<br \/>d) The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the<br \/>World Health Organization and COVID-19 is extremely contagious. The Organization has put in<br \/>place preventative measures to reduce the spread of COVID-19; however, the Organization<br \/>cannot guarantee that the Participant will not become infected with COVID-19. Further,<br \/>attending the Activities could increase your risk of contracting COVID-19.<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>The Participant is participating voluntarily in the Activities. In consideration of that<br \/>participation, the Parties hereby acknowledge that they are aware of the risks, dangers and<br \/>hazards and may be exposed to such risks, dangers and hazards. The risks, dangers and hazards<br \/>include, but are not limited to:<br \/>a) Contracting COVID-19 or any other contagious disease;<br \/>b) Executing strenuous and demanding physical techniques;<br \/>c) Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements;<br \/>d) Exerting and stretching various muscle groups;<br \/>e) The failure to properly use any piece of equipment or from the mechanical failure of<br \/>any piece of equipment;<br \/>f) Spinal cord injuries which may render the Participant permanently paralyzed;<br \/>g) Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other<br \/>aspects of the Participant\u2019s body or to the Participant\u2019s general health and well-being;<br \/>h) Abrasions, sprains, strains, fractures, or dislocations;<br \/>i) Privacy breaches, hacking, technology malfunction or damage;<br \/>j) Concussion or other head injuries, including but not limited to, closed head injury or<br \/>blunt head trauma;<br \/>k) Physical contact with other participants, spectators, equipment, and hazards;<br \/>l) Not wearing appropriate safety or protective equipment, such as a helmet;<br \/>m) Failure to act safely or within the Participant\u2019s ability or within designated areas;<br \/>n) Grass, turf, and other surfaces including bacterial infections and rashes;<br \/>o) Collisions with fences, poles, stands, and soccer equipment;<br \/>p) Negligence of other persons, including other spectators, participants, or employees;<br \/>q) Weather conditions; and<br \/>r) Travel to and from competitive events and associated non-competitive events which<br \/>are an integral part of the Activities.<br \/>\uf0d8 We have read and agree to be bound by paragraphs 1 and 4<br \/>Terms<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>In consideration of the Organization allowing the Participant to participate in the Activities,<br \/>the Parties agree:<br \/>a) That the Participant\u2019s mental and physical condition is appropriate to participate in<br \/>the Activities;<br \/>b) That when the Participant practices or trains in his or her own space, the Parties are<br \/>responsible for the Participant\u2019s surroundings and the location and equipment that is selected<br \/>for the Participant;<br \/>c) To comply with the rules and regulations for participation in the Activities;<br \/>d) To comply with the rules of the facility or equipment;<br \/>e) That if the Participant observes an unusual significant hazard or risk, the Participant<br \/>will remove themselves from participation and bring such to the attention of an Organization<br \/>representative immediately;<br \/>f) The risks associated with the Activities are increased when the Participant is impaired<br \/>and the Participant agrees not to participate if impaired in any way;<br \/>g) That it is their sole responsibility to assess whether any Activities are too difficult for<br \/>the Participant. By the Participant commencing an Activity, they acknowledge and accept the<br \/>suitability and conditions of the Activity;<br \/>h) That they are responsible for the choice of the Participant\u2019s protective equipment and<br \/>the secure fitting of the protective equipment;<br \/>i) That COVID-19 is contagious in nature and the Participant may be exposed to or<br \/>infected by COVID-19 and such exposure may result in personal injury, illness, permanent<br \/>disability or death and voluntarily agree to assume all of the foregoing risks.<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>In consideration of the Organization allowing the Participant to participate, the Parties agree:<br \/>a) That the Parties are not relying on any oral or written statements made by the<br \/>Organization or their agents, whether in brochure or advertisement or in individual<br \/>conversations, to agree to be involved in the Activities; and<br \/>b) That the Organization is not responsible or liable for any damage to the Participant\u2019s<br \/>vehicle, property, or equipment that may occur as a result of the Activities.<br \/>\uf0d8 We have read and agree to be bound by paragraphs 4-6<br \/>General<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>The Parties agree that in the event that they file a lawsuit against the Organization, they<br \/>agree to do so solely in the province of Ontario, Canada and they further agree that the<br \/>substantive law of Ontario will apply without regard to conflict of law rules.<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>The Parties expressly agree that this Agreement is intended to be as broad and inclusive as is<br \/>permitted by law and that if any of its provisions are held to be invalid, the balance shall,<br \/>notwithstanding, continue in full legal force and effect.<br \/>Acknowledgement<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>The Parties acknowledge that they have read this agreement and understand it, that they<br \/>have executed this agreement voluntarily, and that this Agreement is to be binding upon<br \/>themselves, their heirs, their spouses, parents, guardians, next of kin, executors, administrators<br \/>and legal or personal representatives.<\/li>\n<!-- \/wp:list-item --><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:separator --><hr class=\"wp-block-separator has-alpha-channel-opacity\" \/><!-- \/wp:separator -->\n\n<!-- wp:paragraph -->\n<p>Name of Participant (print) Signature of Participant Date of Birth<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:separator --><hr class=\"wp-block-separator has-alpha-channel-opacity\" \/><!-- \/wp:separator -->\n\n<!-- wp:paragraph -->\n<p>Name of Parent or Guardian (print) Signature of Parent or Guardian<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:separator --><hr class=\"wp-block-separator has-alpha-channel-opacity\" \/><!-- \/wp:separator -->\n\n<!-- wp:paragraph -->\n<p>Date<\/p>\n<!-- \/wp:paragraph -->\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>(To be executed by Participants under the age of majority)WARNING!
